Website operator and acceptance

These Terms of Service apply to restaurantequipmentx.shop and to orders placed through the website. By using the website or placing an order, you agree to these Terms, the applicable product description, Return and Refund Policy, Privacy Policy, Shipping and Delivery Policy and Legal Notice. The legally registered operator must be identified in the published Legal Notice before commercial launch.

Eligibility and account security

You must have legal capacity to contract. If purchasing for an organisation, you confirm authority to bind it. You are responsible for accurate account information, password confidentiality and activity conducted through your account. Notify us promptly of suspected unauthorised access.

Product information and professional suitability

We take reasonable care with descriptions and images, but minor non-material variations may occur. Dimensions, voltage, phase, wattage, plug, gas type, pressure, drainage, ventilation, clearance, capacity and included accessories must be checked on the product page and manufacturer materials. Customers must verify site access, installation conditions and compatibility before purchase.

Advice provided by customer support is general unless expressly confirmed as a site-specific professional assessment. Product selection does not transfer responsibility for building, electrical, gas, hygiene, fire-safety, accessibility or workplace compliance from the owner, installer or operator.

Orders and contract formation

Products placed in a cart are not reserved. An automated acknowledgement confirms receipt but does not necessarily mean acceptance. A binding sale is formed when we expressly accept the order or dispatch the goods, subject to mandatory law. We may refuse or cancel an order for stock unavailability, obvious error, suspected fraud, payment failure, delivery restriction, quantity limits or unlawful use, and will refund sums received for cancelled goods.

Prices, taxes and payment

The price and taxes payable are displayed at checkout. Prices may change before an order is placed. Payment must be made through an available checkout method. Payment providers may conduct authentication or fraud checks. You warrant that you are authorised to use the selected method.

Delivery

All orders receive free standard delivery. Estimated delivery is 15-20 calendar days after dispatch unless a different commitment is displayed and accepted. Processing time, dispatch and delivery are distinct. Risk passes according to mandatory law, generally when the consumer or designated third party physically receives the goods. Inspection, installation and use

On delivery, inspect cartons, pallets and equipment safely. Do not install visibly damaged goods. Commercial appliances must be installed and commissioned by appropriately qualified persons where required. Follow manuals, rating plates, cleaning schedules and maintenance requirements. Misuse, incorrect voltage, blocked airflow, insufficient water treatment, grease accumulation or unauthorised modification can create serious hazards.

Returns, withdrawal and legal guarantees

Eligible consumers have a 14-day statutory withdrawal right and may also use our voluntary 30-day return policy under its conditions. French consumers have mandatory legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects. Full procedures and remedies appear in the Return and Refund Policy. Nothing in these Terms limits those rights.

Acceptable use

You may not misuse the website, introduce malicious code, scrape or overload services, attempt unauthorised access, interfere with checkout, submit false information, infringe intellectual-property rights, commit fraud, or use products for unlawful purposes. We may restrict access where reasonably necessary for security or legal compliance.

Intellectual property

Website text, layout, graphics, branding and original content are protected by applicable intellectual-property law. Product names and third-party marks belong to their respective owners. You may view and print reasonable extracts for personal purchasing purposes but may not reproduce, resell or exploit website content without permission.

Reviews and submitted content

If you submit a review, image or other content, you confirm it is accurate, lawful and does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the store, subject to privacy law. We may moderate unlawful, abusive, irrelevant or fraudulent content.

Third-party services

Shopify, payment providers, carriers and other third parties may supply parts of the service. Their own terms may apply to their independent services. We are not responsible for third-party websites merely because they are linked, but this does not remove our responsibility as seller for obligations that law places on us.

Liability

Nothing excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct, death or personal injury caused by fault where applicable, or mandatory consumer remedies. Subject to mandatory law, we are not liable for losses that were not reasonably foreseeable when the contract was made or for business losses suffered by a consumer.

For business customers only, and to the maximum extent permitted by law, indirect loss, loss of profit, revenue, production, contracts, goodwill or business interruption is excluded. Any permitted aggregate limitation will not apply where prohibited by law. Professional users should maintain suitable insurance, maintenance and contingency arrangements.

Force majeure

We are not responsible for delay caused by events beyond reasonable control, such as severe weather, transport disruption, strikes not limited to our workforce, border or customs disruption, public-health measures, cyber incidents, fire, flood, war or government action. We will inform affected customers where reasonably possible and take reasonable steps to reduce the effect. Mandatory cancellation and refund rights remain available.

Changes to these Terms

We may update these Terms prospectively. The version in force when an order is placed normally governs that order, unless a legal change requires otherwise or the parties agree. Continued browsing after a website update does not retroactively change an existing purchase contract.

Governing law and disputes

These Terms are governed by French law, without depriving a consumer resident in another country of mandatory protections of that country. Consumers may bring proceedings in courts having jurisdiction under applicable law. Before mediation, contact info@restaurantequipmentx.shop so we can try to resolve the issue. The operator must appoint and publish details of a competent consumer mediator before trading with French consumers.

Severability, waiver and contact

If a term is unenforceable, the remaining terms continue to apply. Failure to enforce a right is not a waiver. Notices and questions may be sent to info@restaurantequipmentx.shop. No amendment is binding unless agreed in writing or published prospectively as permitted by law.
